Nepal Plans Ordinance to Amend Law on Declaring Disaster-Missing Persons Dead

Law, Justice and Parliamentary Affairs Minister Sobita Gautam says the government is preparing an ordinance to amend legal provisions on declaring missing persons dead and registering their deaths. The change is intended to provide a legal path for people who disappeared in floods and other disasters to be declared dead.

Gautam made the announcement at a meeting of the Parliamentary Special Committee on Climate Change Impacts in the Himalayas, Climate Justice and the Bhote Koshi-Trishuli disaster at Singha Durbar in Kathmandu. The announcement was reported by Khabarhub and News of Nepal.

Proposed legal change

The planned ordinance would amend the legal provisions governing:

  • The process for declaring missing people dead.
  • Death registration for people who went missing in floods and other disasters.

The government is preparing the amendment to address the legal situation of people whose whereabouts remain unknown after disasters.
