Nepal’s Department of Industry has cancelled the trademark registration of Perfect Center Fillz chewing gum following a Supreme Court ruling that the mark was similar to Center Fruit and had been imitated.
The dispute involved Italian confectionery multinational Perfetti Van Melle S.p.A., which owns the Center Fruit trademark. The Supreme Court ruled that the registration of Perfect Center Fillz should be annulled, prompting the department to revoke it.
Trademark registration revoked
The case concerned the use of a mark the court found similar to Center Fruit. The Supreme Court’s decision directed that the Perfect Center Fillz registration be cancelled, and the Department of Industry has now taken that step.
Authorities warn of action if product remains on sale
Authorities have warned that action may be taken if Perfect Center Fillz is still found in the market. The cancellation follows the court’s ruling on the trademark dispute.
